Terms of Service
These terms are the agreement between Tafel and each business that subscribes to a Tafel system. They cover the subscription, payment, your data and our responsibilities. Our POPIA Operator Agreement forms part of them.
1. Who we are and who these terms are for
"Tafel", "we" and "us" mean Tafel, Dunkeld Office Park, 6 North Road, Dunkeld West, 2196, South Africa, contactable at sales@gettafel.co.za. "You" means the business that subscribes, and "your users" means the people you give access to: your staff, chauffeurs, partners and clients.
Tafel is sold to businesses. By signing an order, accepting a quotation, or using a system we set up for you, you agree to these terms on behalf of your business and confirm you are authorised to do so.
2. What you get
- Your own Tafel system: booking, dispatch, the chauffeur app and the other features of the plan you choose (Starter, Business or Fleet), as described on our website or in your quotation.
- Hosting on your own server in a South African data centre (Cape Town or Johannesburg, your choice), with your data encrypted at rest.
- Nightly backups. On the Fleet plan, a backup copy is also kept in the other city.
- Updates: we put new versions live for you, with release notes. Your bookings, settings and branding stay as they are.
- Support by email on business days (Monday to Friday, 08:00 to 17:00, excluding public holidays).
We aim for the system to be available at least 99% of each month, not counting planned maintenance, which we schedule outside business hours where we can and announce in advance.
3. Services you pay others for
Some features use outside services on your own accounts: for example Google Maps, AeroDataBox flight data, Webfleet, WhatsApp Business, Microsoft 365 or Google Workspace, your payment gateway (Yoco, Payfast, Peach Payments, Stitch, Paystack or Adumo) and your accounting package. Those providers bill you directly, under their own terms. We help you connect them, but we are not responsible for their availability, prices or decisions, such as a gateway holding a payout.
Money your guests pay through your payment gateway goes to your gateway account, not to us. We never see or store card numbers.
4. Fees and payment
- Plans are billed monthly in advance, at the price on your quotation. Prices include VAT.
- Invoices are payable within 7 days, by EFT or debit order.
- If an invoice is more than 14 days overdue, we may suspend access after giving you at least 7 days' written notice. Your data is kept safe while access is suspended, and access is restored once the account is paid up.
- We may change our prices with at least 30 days' written notice. If you don't accept a change, you may cancel before it takes effect.
- Once-off work, such as data imports, custom set-up or training beyond your plan, is quoted and agreed before we start.
5. Term and cancellation
Your subscription runs month to month from the date your system goes live, unless your quotation sets a fixed term. Either of us may end it with 30 days' written notice; email is enough. Fees already paid are not refunded, but you keep full access until the end of the notice period.
We may end the subscription sooner, with written notice, if you materially breach these terms and don't fix the breach within 14 days of being asked to, or if you use Tafel unlawfully.
6. Your data
- You own your data: your bookings, clients, passengers, prices and everything else you or your users put into your system. We use it only to provide Tafel to you, as set out in the POPIA Operator Agreement.
- You can export billing records and any one person's information yourself, and ask us for a full export of your data at any time.
- When your subscription ends, we give you a full export on request within 30 days. After that we delete your system, its data and its backups, including any backup copy kept in a second city.
7. Your responsibilities
- Use Tafel lawfully, including POPIA, the Consumer Protection Act and the rules of your payment gateway.
- Publish your own privacy policy and booking terms. The system shows them on your booking form and client portal once you add them in Settings.
- Decide who gets access, give each person the right role, and remove people who leave. Keep sign-in details safe, and tell us straight away if you suspect someone has got in who shouldn't have.
- Keep the information you enter accurate, and only enter personal information you need to run your bookings.
- Don't try to break, overload, copy or reverse-engineer the system, or use it to send spam.
The owner named when your system is set up controls it, including backups, staff roles and the emergency lockdown. We act on the owner's instructions, or those of someone the owner authorises in writing.
8. Intellectual property
Tafel's software, design and documentation belong to us. While your subscription is active, you have a non-exclusive, non-transferable right to use your Tafel system for your business. Your name, logo and branding remain yours. You give us permission to use them only to show them in your own system, and, if you agree, to name you as a client.
9. Confidentiality
Each of us keeps the other's non-public business information confidential and uses it only for this agreement. This continues after the subscription ends.
10. Liability
- We provide Tafel with reasonable skill and care, but no software is free of faults. We don't promise the system will never be interrupted, and we're not responsible for problems caused by the outside services in section 3, your internet connection, or your users.
- Neither of us is liable to the other for indirect or consequential loss, such as lost profit, lost bookings or reputational harm.
- Our total liability under these terms in any 12 months is limited to the fees you paid us in the 3 months before the event that caused the claim.
- These limits don't apply to losses caused by fraud, gross negligence or wilful misconduct, and nothing here takes away rights you have under the Consumer Protection Act where it applies to you.
Neither of us is responsible for delays caused by events beyond reasonable control, such as load-shedding at a data centre, natural disasters, or a widespread internet outage.
11. Changes to these terms
We may update these terms. We'll give you at least 30 days' notice by email of any change that affects you materially. If you don't accept it, you may cancel before it takes effect. The date at the top shows when the terms last changed.
12. General
- These terms, your quotation and the POPIA Operator Agreement are the whole agreement between us. If they conflict, your signed quotation wins, then the Operator Agreement on personal information, then these terms.
- South African law applies, and the courts of South Africa have jurisdiction.
- Notices may be given by email to the addresses each of us has on record, and agreements may be made electronically, as the Electronic Communications and Transactions Act allows.
- If any part of these terms can't be enforced, the rest still applies.
